It's a good thing Pfizer has been slapped with the first generic for its erectile dysfunction drug Viagra, which will make it into the top 10 most popular prescription medicines in the US.
The erectile dysfunction drug is the latest development in a broader campaign aimed at bringing about a new level of drug safety and effectiveness for many patients.
Pfizer Inc. has agreed to pay $1 billion to settle lawsuits over a number of allegations that it made false and misleading information about the use of Viagra by doctors and patients.
It's unclear if the settlement will help consumers, however, as it will include a small upfront payment of $5 million to the National Association of Boards of Pharmacy.
The Viagra patent was challenged in 2010 by Pfizer Inc. after it developed a counterfeit version of the medicine.
The settlement, which will be contingent on a court order, will also include a settlement with Teva Pharmaceutical Industries Ltd. that it may seek in court in December after it withdrew its application for a generic version of the drug.
Pfizer said it would pay $3.5 billion to settle the patent infringement litigation.
It said Pfizer was the first to launch generic Viagra in the US in 2007 and has since gained approval from the FDA for its use in the treatment of erectile dysfunction.
In a separate news release, Pfizer said the settlement would include $1.5 billion in cash and $500 million in legal fees to settle lawsuits over alleged counterfeit products that contained the drug.
It also said it had agreed to pay $250 million to settle cases brought by two other pharmaceutical companies, including Ranbaxy Laboratories Ltd., of New York and GlaxoSmithKline Inc., of San Diego, which had submitted false claims to the U. S. Food and Drug Administration when it tested their products.
The company has been seeking a $1.5 billion settlement and is still pursuing a $250 million payment from the federal government.
Pfizer said it had agreed to pay $1 billion to settle cases brought by Ranbaxy and GlaxoSmithKline over the same issues.
